Terms of Use

Please read these Terms of Use (“Terms”) carefully before using the PushPong app and App Clip (the “Service”), operated by GymStreak Ltd (“GymStreak Labs,” “us,” “we,” or “our”). By downloading, accessing or using the Service you agree to these Terms. If you don’t agree, please don’t use the Service.

Your use of the Service is also governed by our Privacy Policy and, for anything you get from the App Store, by Apple’s Licensed Application End User License Agreement (the “Apple EULA”). If these Terms and the Apple EULA conflict, these Terms apply to the extent permitted.

1. The Service

PushPong is a push-up game. Your iPhone’s camera counts your push-ups on your device, your verified sets go on your squad’s daily board, and the best of the day wears the Day Crown until the squad’s reset. You can race friends in duels and send “Beat my N” challenges. The game is free to play. Optional extras are available with a PushPong Club subscription.

Rep counting is automatic and may occasionally miss or miscount reps (for example in poor light or if you’re partly out of frame). Counts shown in the app are final for the game, and we may correct or remove results we believe are wrong or unfair.

We may change, add or remove features at any time, and the Service may sometimes be unavailable.

2. Health and safety

• Exercise within your own limits. Don’t push through pain to win a crown, a duel or a streak.
• Place your phone somewhere stable, clear the space around you, and use a non-slip surface.
• You use the Service and take part in any exercise at your own risk.

3. Who can use PushPong

You must be at least 13 years old (or the minimum age for digital services in your country, if higher) to use PushPong. If you’re under 18, you need your parent or guardian’s permission, and they should read these Terms with you.

4. Your account

• We create an anonymous account for you when you start. If you delete the app without linking Sign in with Apple, your progress may be lost.
• You’re responsible for activity on your account and for keeping your device and Apple ID secure.
• Your display name and squad names must not impersonate anyone, infringe anyone’s rights, or be offensive, vulgar, hateful or obscene. We may change or hide names that break this rule.
• You can delete your account at any time in the app: You → Account → Delete my data.

5. PushPong Club subscriptions

PushPong Club is an optional auto-renewing subscription that unlocks extras such as push-up coaching and training programs, live form and voice coaching, deeper stats and progress history, and cosmetics. The core game (counting, the Day Crown, squads, duels and challenges) stays free.

Prices in other countries are shown in your local currency in the app before you buy, and may include taxes.

• Payment: payment is charged to your Apple ID account when you confirm the purchase (or, for the yearly plan with a free trial, when the trial ends).
• Auto-renewal: your subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• Free trial: the 3-day free trial on the yearly plan is for new subscribers only. If you don’t cancel at least 24 hours before the trial ends, you’ll be charged $39.99 (or the local equivalent) for a year. Any unused part of a free trial is forfeited when you buy a subscription.
• Cancelling: manage or cancel your subscription in your Apple ID settings: on your iPhone go to Settings → [your name] → Subscriptions → PushPong. Cancelling stops the next renewal; you keep Club until the end of the period you’ve paid for. Deleting the app or your PushPong account does not cancel a subscription.
• Refunds: purchases are processed by Apple, so refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. Nothing in these Terms limits any rights you have under consumer law.
• Price changes: we may change subscription prices. Apple will tell you in advance, and where required ask you to agree, before a new price applies to you.
• Restoring: if you reinstall PushPong or move to a new iPhone with the same Apple ID, use “Restore purchases” in the app.

6. Fair play and conduct

PushPong only works if every rep is real. You agree not to:

• fake or cheat reps, for example with videos, photos, screens, mannequins, other people, or by tampering with the camera feed or the app;
• modify, reverse engineer, or interfere with the app, its servers or its data, or submit results other than through the app’s normal camera flow;
• harass, bully, threaten or impersonate other players, or use offensive, hateful or sexual names;
• create accounts to manipulate boards, duels or challenges, or use automated means to access the Service;
• use the Service for anything unlawful.

You can report a player by long-pressing their name, and block them to hide them from your boards. We review reports within 24 hours and may remove results or names, or suspend or terminate accounts, that break these rules. We have no tolerance for objectionable content or abusive users.

7. Your content

Your display name, squad names, results and challenges (“Your Content”) are shown to other players as part of the game. You keep ownership of Your Content, and you give us a worldwide, non-exclusive, royalty-free licence to host, store, display and use it to run, show and improve the Service. This licence ends when Your Content is deleted, except where it’s already been shared in past boards or challenges as described in our Privacy Policy.

8. Our rights

The Service, including its software, design, graphics, sounds, the PushPong name and logo, is owned by GymStreak Ltd or its licensors and protected by intellectual property laws. We give you a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, for your own non-commercial use, in line with these Terms and the Apple EULA.

9. Termination

You can stop using PushPong at any time and delete your account in the app. We may suspend or terminate your access, without prior notice, if you break these Terms or if we need to for legal or safety reasons. We may also discontinue the Service; if we do and you have an active Club subscription, we’ll tell you in advance where we can. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, and limitations of liability.

10. Disclaimer

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We don’t warrant that the Service will be uninterrupted, secure or error-free, that rep counts will always be accurate, or that using it will achieve any fitness result.

11. Limitation of liability

To the fullest extent permitted by law, GymStreak Ltd and its directors, employees, partners, agents and suppliers won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or other intangible losses, arising from your use of or inability to use the Service, or from the conduct of other players. Our total liability to you for any claim relating to the Service is limited to the greater of the amount you paid us for PushPong Club in the 12 months before the claim, or £50.

Nothing in these Terms excludes or limits liability that can’t be excluded or limited by law, including liability for death or personal injury caused by our negligence, for fraud, or your statutory rights as a consumer.

12. Apple

These Terms are between you and GymStreak Ltd, not Apple. Apple is not responsible for the Service or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it (including product liability, legal or regulatory compliance, or intellectual property claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you’re not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.

13. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict of law rules. If you live elsewhere, you keep any protections of the mandatory consumer laws of your country, and you may bring claims in your local courts. If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver of it.

14. Changes

We may update these Terms from time to time. We’ll post the new version on this page and update the date at the top, and if a change is material we’ll tell you in the app before it takes effect. By continuing to use the Service after changes take effect, you agree to the updated Terms.
